      What Makes Federal Sex Crime Cases Different

      Undercover operations.  A significant proportion of federal online enticement and travel offense prosecutions arise from undercover law enforcement operations in which agents pose as minors in online communications. These operations raise specific legal issues, including the availability of the entrapment defense, the adequacy of probable cause based on the government’s own conduct, and whether the defendant’s communications reflect a predisposition to engage in the alleged conduct or a response to government inducement.

      Sex offender registration.  Federal sex crime convictions trigger registration obligations under the Sex Offender Registration and Notification Act (SORNA). Most federal sex crime convictions result in Tier III classification requiring lifetime registration. Registration restrictions affect residence, employment, internet access, and international travel. Violation of SORNA registration requirements is itself a federal felony carrying up to 10 years in prison.

      Mandatory minimums with limited judicial discretion.  Unlike most federal offenses, many federal sex crimes carry mandatory minimum sentences that the court cannot reduce regardless of individual circumstances, criminal history, or mitigating factors. The specific charges filed (possession versus receipt versus distribution versus production of CSAM, for example) determine which mandatory minimum applies, and challenging how the government has characterized the offense can be the most important defense strategy in the case.
