Wiretap evidence is among the most powerful tools in the federal prosecutor’s arsenal. Intercepted phone calls, text messages, and electronic communications can provide direct evidence of criminal agreements, drug transactions, and organizational structure in ways that no other type of evidence can. When a federal jury hears a defendant’s own voice discussing a drug deal or a fraud scheme, the impact is devastating.

But wiretap evidence is also subject to some of the strictest legal requirements in federal criminal law. Title III of the Omnibus Crime Control and Safe Streets Act (18 U.S.C. §§2510–2522) imposes detailed procedural requirements that the government must satisfy before, during, and after electronic surveillance. When the government fails to comply with these requirements, the intercepted communications may be suppressed which means excluded from evidence entirely.

How Federal Wiretaps Are AuthorizedWiretap Evidence in Federal Cases: How It Works and How to Challenge It

Federal wiretaps require judicial authorization. A federal judge must issue a wiretap order based on a detailed application from the government. The application must demonstrate:

  • Probable cause that a specific individual is committing, has committed, or is about to commit one of the enumerated federal offenses listed in §2516.
  • Necessity — that normal investigative techniques have been tried and failed, reasonably appear unlikely to succeed, or are too dangerous to employ. This is the most significant legal hurdle. The government cannot simply assert that a wiretap would be helpful; it must explain why other methods are insufficient.
  • Particularity — the application must identify the specific communications facility (phone number, email account) to be tapped, the specific offenses being investigated, and the specific types of communications to be intercepted.
  • Duration — wiretap orders are limited to 30 days but can be renewed with new applications demonstrating continued necessity.

Requirements During Interception

Minimization

The most frequently litigated issue in wiretap cases. Federal agents conducting a wiretap are required to minimize the interception of communications that are not related to the criminal activity under investigation. This means agents must stop listening when a conversation is clearly not pertinent such as personal calls, discussions with family and conversations about unrelated topics. Minimization is not optional; it is a statutory requirement. When agents fail to minimize, such as when they listen to and record every conversation regardless of content, the defense can move to suppress the improperly intercepted communications.

Sealing

Upon expiration of the wiretap order, the recordings must be immediately sealed under the direction of the issuing judge. The purpose of sealing is to prevent tampering. Delays in sealing can provide grounds for suppression if the government cannot satisfactorily explain the delay.

How We Challenge Wiretap Evidence

Lee Bright challenges wiretap evidence at multiple levels:

  • Did the government genuinely exhaust or reasonably consider alternative investigative techniques before seeking a wiretap? Lee reviews the necessity affidavit to determine whether the government’s claims are supported by the record or are boilerplate assertions recycled from other cases.
  • Probable cause. Was the information supporting probable cause reliable and current? Was it based on independent investigation or solely on the uncorroborated word of a cooperating witness?
  • Minimization compliance. Lee reviews the interception logs to determine whether agents properly minimized non-pertinent calls. Systemic failure to minimize can result in suppression of large portions of the wiretap evidence.
  • Scope limitations. Did the agents intercept communications beyond the scope of the authorized order? Were conversations from unauthorized phone numbers or facilities intercepted?
  • Sealing requirements. Was the sealing done promptly? Were there unexplained delays?
  • Does the defendant have standing to challenge the wiretap? In multi-defendant cases, standing issues can be complex and outcome-determinative.

The Impact of Successful Wiretap Challenges

A successful motion to suppress wiretap evidence can fundamentally change the trajectory of a federal case. In drug conspiracy cases, wiretap evidence is often the primary evidence connecting specific defendants to the conspiracy and establishing the scope of their involvement. Without it, the government may be forced to rely solely on cooperating witness testimony which is far more vulnerable to cross-examination. In some cases, suppression of wiretap evidence leads to dismissal of charges entirely.
