    What Actually Happens to an Assault Case in Dallas County

    Dallas County runs its criminal cases differently from the counties around it. These are the local specifics that shape a defense here.

    Where your case is heard

    Misdemeanor assault charges are heard in the County Criminal Courts and felonies in the Criminal District Courts, both at the Frank Crowley Courts Building.

    Who prosecutes

    The Dallas County District Attorney runs a specialized family violence unit, and assault cases are worked by prosecutors who handle them every day. The defense has to be built to that standard.

    Aggravated assault is a second-degree felony

    Serious bodily injury or a deadly weapon turns a misdemeanor assault into a second-degree felony with two to twenty years of exposure. What counts as serious, and whether the object was a deadly weapon, is argued from the medical records and the video.

    Self-defense is decided on the evidence

    Texas lets you use force to protect yourself, but the jury decides who started it from the 911 audio, the injuries on both sides, and the witnesses. We preserve all of it before the story hardens.

    The other person cannot drop the case

    Only the District Attorney can dismiss. A recanting or unwilling witness changes the evidence picture, not the charge, and Dallas County prosecutors are trained to go forward without one.

    North Dallas and Preston Hollow

    An assault call in North Dallas or Preston Hollow is answered by the Dallas Police North Central Division, and the case is filed with the Dallas County DA like any other. The arrest books at Lew Sterrett and the case is set at Frank Crowley. Our Oak Lawn office is about 15 minutes down the Dallas North Tollway.

    Oak Cliff and South Dallas

    Southwest and South Central Division arrests make up a large share of the county’s assault docket. Those cases follow the same path through Lew Sterrett and the County Criminal Courts, and our office is about 15 minutes away up I-35E.

    Lakewood, East Dallas, and White Rock

    Northeast Division territory. An assault arrest there is a Dallas County case at Frank Crowley, and our office is a 15-minute drive west across Mockingbird Lane.

    Irving and Grand Prairie

    An Irving PD arrest is a Dallas County case, booked through the Irving city jail before it is filed with the Dallas County DA and set at Frank Crowley. Grand Prairie sits in Dallas, Tarrant, and Ellis counties, so the address on the offense report decides whether the case is heard in Dallas, Fort Worth, or Waxahachie.     Carrollton

    Carrollton spans Dallas, Denton, and Collin counties, and a Carrollton PD assault arrest is filed in whichever county the address falls in. The Dallas County side goes to Frank Crowley, the Denton side to the Denton County Courts Building, and the Collin side to McKinney. Our Carrollton page explains how to tell which one has your case.     Richardson

    Richardson straddles the Dallas and Collin county line. A Richardson PD arrest south of the line is a Dallas County case; north of it, the case is heard in McKinney by the Collin County DA instead. See our Richardson page. The office is about 20 minutes south on US-75.

    Highland Park and University Park

    The Park Cities have their own agencies, Highland Park DPS and University Park PD, but both towns sit entirely inside Dallas County, so the case is filed with the Dallas County DA and heard at Frank Crowley.     Garland

    Garland PD arrests are Dallas County cases unless the address falls in the slivers of the city that reach into Collin or Rockwall County. Garland holds arrestees at its own detention center before the case is filed with the Dallas County DA. The office is about 25 minutes away on I-635 and US-75.

    Mesquite

    Mesquite PD books through the Mesquite city jail, and the case is filed in Dallas County unless the arrest fell in the small part of the city that lies in Kaufman County, where it is heard in Kaufman instead.     Cedar Hill, DeSoto, Duncanville, and Lancaster

    The Best Southwest cities are Dallas County, except for the part of Cedar Hill that crosses into Ellis County, where a case goes to the courthouse in Waxahachie.     Dallas Assault Charge Questions, Answered

    Can the other person drop the charges?

    No. Once an arrest is made, the case belongs to the District Attorney, not the complaining witness. A witness who recants or declines to cooperate changes the evidence picture, and we use that, but the decision to dismiss is the State’s alone.

    What is the difference between assault and aggravated assault in Texas?

    Assault is causing bodily injury, threatening imminent bodily injury, or offensive contact. Aggravated assault adds serious bodily injury or a deadly weapon, and it is a second-degree felony carrying two to twenty years. Whether an injury was serious, and whether an object was a deadly weapon, are the questions the case turns on.

    Is a Class C assault a criminal record?

    Yes. A Class C assault by contact is a fine-only offense, but it is still a criminal charge that appears on a background check unless it is dismissed or later expunged. A deferred disposition in municipal court can end without a conviction, which is worth pursuing even on a ticket.

    Which court will my Dallas assault case be in?

    Misdemeanor assault charges are heard in the County Criminal Courts and felonies in the Criminal District Courts, both at the Frank Crowley Courts Building at 133 N. Riverfront Blvd. Your court assignment appears on your bond paperwork.

    Can my case be dismissed before trial?

    Some are. Felonies can be no-billed by the grand jury, charges can be rejected or reduced at intake, and suppression of illegally obtained evidence can leave the State unable to proceed. Whether any of those paths is open depends on the evidence, which is why we pull the full discovery file first.

    How much does a Dallas assault lawyer cost?

The fee depends on the charge level, since a Class A family violence misdemeanor costs less to defend than a felony aggravated assault, and on whether the case is headed to trial.     Can I claim self-defense in a Dallas assault case?

    Yes. Texas law lets you use force when you reasonably believe it is immediately necessary to protect yourself, and the State then has to disprove it beyond a reasonable doubt. The claim lives or dies on the 911 audio, the injuries on both sides, and the witnesses, so preserving that evidence early is the first job.

    What happens after an assault arrest in Dallas County?

    You are booked at the Lew Sterrett Justice Center and taken before a magistrate, usually within 24 to 48 hours, who sets bond and can issue an emergency protective order on the spot. The Dallas County DA then decides whether to file the case and at what level. A misdemeanor gets a first setting in the County Criminal Courts at Frank Crowley within a few weeks; a felony goes to a grand jury first. Call before that first setting, because the protective order terms and the early evidence are still moveable then.

    Will I go to jail for a first offense?

    A first family violence assault is a Class A misdemeanor, which carries up to a year in the Dallas County jail and a $4,000 fine. In practice a first offense far more often ends in a dismissal, a reduction, or probation, and the real fight is over the affirmative finding, because a deferred adjudication that avoids jail still carries it. The time you already spent in Lew Sterrett counts against any sentence.

    What is assault on a public servant?

    Assault causing bodily injury to a police officer, jailer, or other public servant while they are on duty, charged as a third-degree felony under Penal Code §22.01(b). These cases turn on the body camera video, and in Dallas County that video exists for nearly every arrest.
