    What Actually Happens to an Assault Case in Tarrant County

    Tarrant County runs its criminal cases differently from the counties around it. These are the local specifics that shape a defense here.

    Misdemeanor assault charges are heard in the County Criminal Courts and felonies in the district courts, both at the Tim Curry Criminal Justice Center at 401 W. Belknap Street.

    Aggravated assault is a second-degree felony

    Serious bodily injury or a deadly weapon turns a misdemeanor assault into a second-degree felony with two to twenty years of exposure. What counts as serious, and whether the object was a deadly weapon, is argued from the medical records and the video.

    Arlington police book arrests at the city jail before the case is filed with the Tarrant County DA, and the entertainment district around AT&T Stadium and Globe Life Field produces a steady run of these cases. Every one of them is heard at Tim Curry, about 25 minutes from our office.

    Grapevine, Southlake, and Colleyville

    Grapevine sits on the TX-114 and TX-121 corridor beside DFW Airport, Southlake runs its police and fire services as a single Department of Public Safety, and Colleyville patrols TX-26 and Glade Road heavily. The municipal courts in all three keep only Class C tickets; anything Class B or above is a Tarrant County case heard downtown, 20 to 25 minutes from our office.

    Keller

    Keller’s municipal court keeps only Class C tickets. A Keller arrest for anything higher, including a charge that started as a stop on US-377 or Keller Parkway, is filed in Tarrant County and heard at Tim Curry, about 20 minutes from our office.

    Euless, Hurst, and Bedford

    The Mid-Cities anchor the Airport Freeway corridor about fifteen minutes east of our office, and each city jail holds an arrestee before the county transfer. Cases from the HEB cities are filed with the Tarrant County DA and heard at Tim Curry.

    Mansfield

    Mansfield straddles Tarrant, Johnson, and Ellis counties, and the county line decides the courthouse: a Tarrant-side arrest goes to Tim Curry, a Johnson-side arrest to the Guinn Justice Center in Cleburne.       From 401 W. Belknap Street, head east on Belknap, which becomes Airport Freeway (SH-121). Stay on the access road and the office is at 4500 Airport Freeway, near the I-820 interchange.

    2. From Downtown Fort Worth / Sundance Square 6.2 mi / 12 min

      From downtown, take Belknap Street northeast onto Airport Freeway (SH-121 North). Follow the frontage road to 4500 Airport Freeway.

    3. From Hurst / Euless / Bedford (Mid-Cities) 8.4 mi / 14 min

      Take Airport Freeway (SH-121/183) west toward Fort Worth. Exit near Beach Street and the office is just off the access road at 4500 Airport Freeway.

    4. From Arlington 18.0 mi / 25 min

      Take SH-360 north to Airport Freeway (SH-121/183) west, or I-30 west to I-820 north. The office is just off Airport Freeway at the I-820 interchange.

    Can the other person drop the charges?

    No. Once an arrest is made, the case belongs to the District Attorney, not the complaining witness. A witness who recants or declines to cooperate changes the evidence picture, and we use that, but the decision to dismiss is the State’s alone.

    What is the difference between assault and aggravated assault in Texas?

    Assault is causing bodily injury, threatening imminent bodily injury, or offensive contact. Aggravated assault adds serious bodily injury or a deadly weapon, and it is a second-degree felony carrying two to twenty years. Whether an injury was serious, and whether an object was a deadly weapon, are the questions the case turns on.

    Can I claim self-defense in a Fort Worth assault case?

    Yes. Texas law lets you use force when you reasonably believe it is immediately necessary to protect yourself, and the State then has to disprove it beyond a reasonable doubt. The claim lives or dies on the 911 audio, the injuries on both sides, and the witnesses, so preserving that evidence early is the first job.

    Which court will my Fort Worth assault case be in?

    Misdemeanor assault charges are heard in the County Criminal Courts and felonies in the district courts, both at the Tim Curry Criminal Justice Center at 401 W. Belknap Street in downtown Fort Worth. Your court assignment appears on your bond paperwork.

    Can my case be dismissed before trial?

    Some are. Felonies can be no-billed by the grand jury, charges can be rejected or reduced at intake, and suppression of illegally obtained evidence can leave the State unable to proceed.     A magistrate sets bond within 48 hours of booking, and the amount and conditions can be argued before that hearing. A bondsman posts a surety bond for a fee; a cash bond is refunded when the case ends.

    Is a Class C assault a criminal record?

    Yes. A Class C assault by contact is a fine-only offense, but it is still a criminal charge that appears on a background check unless it is dismissed or later expunged. A deferred disposition in municipal court can end without a conviction, which is worth pursuing even on a ticket.

    What is assault on a public servant?

    Assault causing bodily injury to a police officer, jailer, or other public servant while they are on duty, charged as a third-degree felony under Penal Code §22.01(b). These cases turn on the body camera video, and in Tarrant County that video exists for nearly every arrest.

    Will I go to jail for a first assault charge in Tarrant County?

    Most first-offense misdemeanor assault cases in Tarrant County resolve without a jail sentence, through dismissal, deferred adjudication, or probation, even though the punishment range allows it. Aggravated assault carries real exposure, but a felony also has options that a plea at the first setting does not, starting with the grand jury.
