    Which court will my Dallas drug case be in?

    Misdemeanor drug charges are heard in the County Criminal Courts and felonies in the Criminal District Courts, both at the Frank Crowley Courts Building at 133 N. Riverfront Blvd. Your court assignment appears on your bond paperwork.

    Is a THC vape really a felony?

    It can be. Marijuana flower in a small amount is a Class B misdemeanor, but THC concentrates, including vape pens and edibles, sit in Penalty Group 2, where possession of any usable amount is a felony. The lab's concentration analysis is where that charge is fought.

    The drugs were not mine. Does that matter?

    Possession requires knowing care, custody, or control, and proximity alone is not enough. A shared car or a shared apartment is exactly where these cases get fought, along with how the search happened in the first place.

    What is a drug-free zone enhancement?

    An allegation that the offense happened within a designated zone, such as near a school or playground, raises the charge level and can restrict probation. The measurement and the map are both contestable.

    Can my case be dismissed before trial?

    Some are. Felonies can be no-billed by the grand jury, charges can be rejected or reduced at intake, and suppression of illegally obtained evidence can leave the State unable to proceed. Whether any of those paths is open depends on the evidence, which is why we pull the full discovery file first.
