Facing a Family Violence Charge in Tarrant County?

Deandra Grant Law is a Fort Worth domestic violence law firm defending family violence charges in Fort Worth and throughout Tarrant County. Family violence is not a separate crime in Texas. It is an assault charge with a relationship attached: a spouse, an ex, a dating partner, a roommate, or a relative. That one fact changes how Tarrant County handles the case. The Tarrant County District Attorney’s Office prosecutes these cases through a dedicated family violence unit, the misdemeanors are heard in the County Criminal Courts at the Tim Curry Criminal Justice Center by prosecutors who work nothing else, and the felonies go to the Criminal District Courts in the same building.

The first order usually arrives before you do. At magistration inside the Tarrant County Corrections Center, the magistrate can issue an emergency protective order under Article 17.292 of the Code of Criminal Procedure, and must issue one when the allegation involves serious bodily injury or a deadly weapon. An EPO runs 31 to 61 days, or up to 91 days when a weapon is alleged, and it can bar you from your own home and from any contact with the complaining witness. Violating it is a new charge under Penal Code §25.07, even if the other person made the call. A longer civil protective order, up to two years and sometimes more, can follow through the family courts.

Then there is the enhancement. A first family violence assault is a Class A misdemeanor, but a prior family violence conviction, an allegation of choking or impeding breath, or two incidents inside twelve months makes it a third-degree felony with two to ten years of exposure. Whatever the charge level, an affirmative finding of family violence under Article 42.013 follows a conviction or a deferred adjudication: a federal firearm ban, a record that cannot be sealed, and a felony the next time anyone makes an allegation. The defense is built on the same evidence the State fixed in the first days. Partner Douglas Huff is an ACS-CHAL Forensic Lawyer-Scientist with digital forensics training, and managing partner Deandra Grant is a former prosecutor with more than 30 years of trial experience who has taught evidence CLEs for the Tarrant County Criminal Defense Lawyers Association; the Fort Worth domestic violence lawyer on your case treats the finding, not just the charge, as the fight. Physical evidence, from DNA swabs to toxicology, is tested at the Tarrant County Medical Examiner’s crime laboratory, and we read the bench notes rather than the summary. Our Texas domestic violence guide covers the statute; this page covers how it plays out in Fort Worth, ten minutes from our Airport Freeway office.

    Act Early

The first days shape the whole case

Evidence gets preserved, or it gets lost. Witnesses get found, or they scatter. A defense that starts before indictment has options one that starts at arraignment does not.

    Local Knowledge

What Actually Happens to a Family Violence Case in Tarrant County

Tarrant County runs its criminal cases differently from the counties around it. These are the local specifics that shape a defense here.

    Where your case is heard

Misdemeanor family violence charges are heard in the County Criminal Courts and felonies in the Criminal District Courts, both at the Tim Curry Criminal Justice Center at 401 W. Belknap Street in downtown Fort Worth.

    Who prosecutes

The Tarrant County District Attorney prosecutes family violence through a dedicated unit whose prosecutors work these cases every day. The defense has to be built to that standard.

    The protective order comes first

An emergency protective order can issue at magistration, before you are released, and it can keep you out of your own home for 31 to 91 days. Its terms can be modified, but only by going back to court.

    The finding is the fight

An affirmative family violence finding carries firearm restrictions under federal law, cannot be sealed, and turns a future allegation into a felony. How a case resolves matters as much as whether it does.

The complaining witness cannot drop the case

Only the District Attorney can dismiss. A recanting or unwilling witness changes the evidence picture, not the charge, and Tarrant County prosecutors are trained to go forward without one.

    Bond conditions follow you home

Family violence bonds in Tarrant County commonly carry no-contact conditions and can include GPS monitoring. A violation is a new arrest, so the conditions are argued at magistration and revisited at the first setting.

What We Do on Every Case

From the first call, in order:

    • Reach the case before indictment when we can, where a grand jury packet can end it before a charge is filed
    • Demand the dash, body, and surveillance video before it’s destroyed
    • Pull the full discovery file under Article 39.14: offense reports, witness statements, forensic records
    • Examine the forensic evidence ourselves: lab records, chain of custody, the underlying data, not the summary
    • Investigate the case the police didn’t: the witnesses never interviewed, the footage never pulled
    • File the motions the evidence supports, because suppression is how weak cases end
    • Build your mitigation file, with clinical assessments, at no cost to you
    • Try the case if the offer isn’t right, which is why the offers get better

Intake answers 24/7, and if we can take your case, the consultation with an attorney is free. We quote a flat fee there, so the investment is known before you commit.

I’m so appreciative of working with Deandra Grant Law. I had the pleasure to work with Sorsha and Kevin, both were very supportive and communicative throughout the process. My needs were unique given that I am a veteran and had to work with the Veteran’s Treatment Court which required quite a bit of red tape to work through and I’m glad I had this firm to ensure my acceptance into the Veteran’s Treatment Court. Thank you and I totally recommend this firm to all especially my fellow veterans.

    Serving All of Tarrant County

We defend family violence cases from every corner of Tarrant County: Fort Worth itself plus Arlington, Hurst, Euless, Bedford, North Richland Hills, Grapevine, Southlake, Keller, Colleyville, Mansfield, Haltom City, and Watauga. Wherever the call came from, a family violence arrest is booked and magistrated at the Tarrant County Corrections Center, the emergency protective order is decided there, and the case is filed by the family violence unit and set at Tim Curry, a building we work in every week.

Every charge we defend here has its own walkthrough: Fort Worth Criminal Defense Lawyer, Fort Worth DWI Lawyer, Fort Worth Assault Lawyer, Fort Worth Drug Crimes Lawyer, and Fort Worth Sex Crimes Lawyer. The courthouse, the jail, and the bond process are covered in our Tarrant County court guide.

Downtown, the Near Southside, and the Stockyards

Fort Worth Police answer the call, the arrest books at the Corrections Center at 100 N. Lamar Street, and the case is filed with the family violence unit a block away at Tim Curry. Our office is about ten minutes east on Airport Freeway.

    Arlington

Arlington police book arrests at the city jail before the case is filed with the Tarrant County DA, and the entertainment district around AT&T Stadium and Globe Life Field produces a steady run of assault and family violence calls. Every one of those cases is heard at Tim Curry, about 25 minutes from our office.

    Euless, Hurst, and Bedford

The Mid-Cities anchor the Airport Freeway corridor about fifteen minutes east of our office, and each city jail holds an arrestee before the county transfer. Family violence cases from the HEB cities are filed with the Tarrant County DA and heard at Tim Curry.

North Richland Hills, Haltom City, and Watauga

The Northeast Tarrant cities each run their own police department and file family violence cases with the Tarrant County DA. The protective order is decided at magistration in the same way, and our office is about fifteen minutes away.

    Grapevine, Southlake, and Colleyville

Grapevine sits beside DFW Airport, Southlake runs its police and fire services as a single Department of Public Safety, and Colleyville is a small city with active patrols. The municipal courts in all three keep only Class C tickets; a family violence arrest is a Tarrant County case heard downtown, 20 to 25 minutes from our office.

    Keller

Keller’s municipal court keeps only Class C tickets, so a Keller family violence arrest is filed in Tarrant County and heard at Tim Curry. Our office is about 20 minutes away.

    Mansfield

Mansfield straddles Tarrant, Johnson, and Ellis counties, and the county line decides the courthouse: a Tarrant-side arrest goes to Tim Curry, a Johnson-side arrest to the Guinn Justice Center in Cleburne. The address on the offense report settles it, and our Johnson County court guide covers Cleburne.

    Burleson

Most of Burleson lies in Johnson County, so most Burleson family violence cases are heard in Cleburne rather than Fort Worth; only the northern, Tarrant County side of the city goes to Tim Curry. The Tarrant County court guide covers the building, the bond process, and what to expect at the first setting.

    A Different Kind of Case?

The Rest of What We Defend

The same attorneys handle these charges in the same courthouses.

    Tarrant County

Fort Worth Domestic Violence Questions, Answered

Can the victim drop the charges?

No. Once an arrest is made, the case belongs to the District Attorney, not the complaining witness. A witness who recants or declines to cooperate changes the evidence picture, and we use that, but the decision to dismiss is the State’s alone, and Tarrant County’s family violence unit is trained to go forward without a cooperating witness.

What does an affirmative family violence finding do?

It restricts firearm possession under federal law, turns a future family violence allegation into a felony, and generally cannot be sealed from your record. It can attach even to a plea that avoids jail, which is why the finding itself, not just the sentence, is what we defend against.

There is a protective order against me. Can I go home?

Only if its terms allow it. Violating a protective order is a separate criminal charge, and it applies even when the protected person invites the contact. The order’s terms can be modified, but that happens in court, not by agreement between the two of you.

Which court will my Fort Worth family violence case be in?

Misdemeanors are heard in the County Criminal Courts and felonies in the Criminal District Courts, both at the Tim Curry Criminal Justice Center at 401 W. Belknap Street in downtown Fort Worth. Your court assignment appears on your bond paperwork, and your first setting usually comes within a few weeks of release.

What happens after a family violence arrest in Tarrant County?

Booking at the Tarrant County Corrections Center, magistration within 48 hours where bond, bond conditions, and usually an emergency protective order are set, then release. The case is filed by the family violence unit and set at Tim Curry. The earliest days are when the 911 audio, body camera video, and photographs can still be preserved and examined.

Is domestic violence a felony in Texas?

A first family violence assault is a Class A misdemeanor. It becomes a third-degree felony with a prior family violence conviction, an allegation of choking or impeding breath, or two incidents within twelve months, and a second-degree felony when serious bodily injury or a deadly weapon is alleged.

Will I go to jail for a first family violence offense in Tarrant County?

Most first-offense misdemeanor cases resolve without jail time, and some resolve without a conviction. What decides it is the evidence and how the case is resolved, because a deferred adjudication still carries the affirmative finding. We fight the finding first.

Can I own a gun after a family violence conviction?

Under Texas law a person convicted of a family violence misdemeanor cannot possess a firearm for five years after release from confinement or community supervision. Under federal law the ban on a misdemeanor crime of domestic violence has no end date. That is one of the reasons the finding, not just the sentence, is the fight.

How much does a Fort Worth domestic violence lawyer cost?

It varies with the charge level and whether the case is headed to trial, and we are direct about numbers at the first call. If we can take your case, the consultation with an attorney is free, we offer payment plans, and we quote a flat fee so the investment is known before you commit.

    What is continuous family violence?

Two or more assaults against family or household members within a twelve-month period, charged together as a third-degree felony under Penal Code §25.11 even if neither incident produced a conviction on its own. Our continuous family violence page explains how the State proves it.

Have a different question? Ask Deandra answers the ones people ask in the first call, and the Tarrant County court guide covers the building itself.
