Texas Drug Penalty Groups Explained
The Texas Controlled Substances Act (Texas Health and Safety Code, Chapter 481) classifies controlled substances into penalty groups that determine the severity of criminal charges. The penalty for a drug offense depends on two factors: which penalty group the substance falls in and the weight of the substance. Understanding the penalty group system is essential to understanding your drug charges.
Penalty Group 1
The most serious category. Includes:
- Cocaine and crack cocaine
- Heroin
- Methamphetamine
- Fentanyl and fentanyl analogs
- Oxycodone (OxyContin, Percocet)
- Hydrocodone (Vicodin, Norco)
- Codeine (in certain concentrations)
- Morphine
- Opium
- Ketamine
- GHB (gamma-hydroxybutyric acid)

Penalty Group 1-A
Contains only LSD (lysergic acid diethylamide). Penalties are measured by number of abuse units (doses) rather than weight:
- Fewer than 20 units: State jail felony
- 20–80 units: Third-degree felony
- 80–4,000 units: Second-degree felony
- 4,000–8,000 units: First-degree felony
- 8,000+ units: Enhanced first-degree felony
Penalty Group 2
Includes:
- THC concentrates (vape cartridges, wax, shatter, edibles, oils)
- PCP (phencyclidine)
- Psilocybin (mushrooms)
- Mescaline
- MDMA (ecstasy/molly)
- Amphetamine (including Adderall)
- Synthetic cannabinoids (K2, Spice)
Same weight-based penalty structure as Penalty Group 1.
Penalty Group 2-A
Contains synthetic cannabinoid compounds not listed in PG2. Penalties follow the same structure as PG2.
Penalty Group 3
Includes:
- Benzodiazepines (Xanax, Valium, Klonopin, Ativan)
- Anabolic steroids
- Certain prescription stimulants (Ritalin/methylphenidate)
- Certain barbiturates
- Peyote
Possession penalties:
- Less than 28 grams: Class A misdemeanor (up to 1 year, $4,000 fine)
- 28–200 grams: Third-degree felony
- 200–400 grams: Second-degree felony
- 400+ grams: First-degree felony with enhanced penalties
Penalty Group 4
Includes compounds containing limited quantities of narcotics mixed with non-narcotic ingredients — certain prescription cough syrups, preparations containing small amounts of codeine, and similar formulations.
Penalty structure mirrors Penalty Group 3.
Marijuana
Marijuana (the plant material) is classified separately from the penalty groups under §481.121:
- 2 ounces or less: Class B misdemeanor (up to 180 days, $2,000 fine)
- 2–4 ounces: Class A misdemeanor (up to 1 year, $4,000 fine)
- 4 ounces to 5 pounds: State jail felony
- 5–50 pounds: Third-degree felony
- 50–2,000 pounds: Second-degree felony
- 2,000+ pounds: Enhanced first-degree felony
Important: THC concentrates (vape pens, edibles, wax) are NOT classified as marijuana. They fall under Penalty Group 2 with much harsher penalties.
