When your driver’s license is suspended after a DWI arrest in Texas, whether through the ALR process, a DWI conviction, or a refusal to provide a specimen, losing the ability to drive can create an immediate crisis. You may not be able to get to work, take your children to school, attend court hearings, or handle basic daily responsibilities. An occupational driver’s license (ODL) is a restricted license that allows you to drive for essential purposes during the suspension period.

What Is an Occupational Driver’s License?
An occupational driver’s license is a court-ordered restricted license that permits driving for essential needs such as work, school, household duties, medical appointments, and community supervision obligations during a period of license suspension. The ODL allows driving for up to 12 hours per day during specified time windows set by the court.
Eligibility
You may be eligible for an ODL if your license was suspended due to:
- An ALR suspension following a DWI arrest (failure or refusal of breath/blood test)
- A DWI conviction
- A surcharge suspension for failure to pay DPS surcharges
- Certain other suspensions unrelated to DWI
You are not eligible for an ODL if:
- Your license is suspended for a conviction for intoxication manslaughter during the mandatory suspension period
- You have been convicted of a second or subsequent DWI within 5 years and are within the first mandatory suspension period
- You are a commercial driver seeking to operate a commercial vehicle during a CDL disqualification
How to Obtain an ODL
The process for obtaining an occupational driver’s license in Texas involves:
- Filing a petition with the court in the county where you reside. The petition must include the reason for the suspension, your essential need for driving, and the proposed driving schedule.
- Obtaining SR-22 insurance — a certificate of financial responsibility that your auto insurance company files with DPS. SR-22 insurance is typically more expensive than standard coverage and must be maintained for the duration of the suspension and the ODL period.
- Court hearing — the judge reviews the petition and, if approved, issues a court order specifying the hours and geographic area in which you are permitted to drive.
- Filing the court order with DPS — once the judge signs the order, it must be filed with the Texas Department of Public Safety, which issues the restricted license.
Ignition Interlock Requirements
In many DWI-related license suspensions, the court or DPS will require installation of an ignition interlock device (IID) as a condition of the occupational driver’s license. The IID requires you to provide a breath sample before the vehicle will start and periodically while driving. If alcohol is detected, the vehicle will not start (or will log a violation if detected while driving).
Ignition interlock is generally required for:
- First-offense DWI with BAC of 0.15 or higher
- Second or subsequent DWI offenses
- Any DWI involving an accident
- DWI with a child passenger
- As a condition of bond in some courts
