Misdemeanor criminal cases in Dallas County are heard in the County Criminal Courts, located on the 3rd and 4th floors of the Frank Crowley Courts Building. Felony cases go to the district courts located on the 5th, 6th and 7th floors in the same building. The Frank Crowley Courts Building is located at 133 N. Riverfront Boulevard (previously Industrial Boulevard).
Blood draws in Dallas DWI cases are typically analyzed at the Southwestern Institute of Forensic Sciences (SWIFS), located on North Stemmons Freeway. SWIFS uses gas chromatography with flame ionization detection which is a reliable methodology when performed correctly, and a source of challenge when it is not. Chain of custody errors, insufficient sodium fluoride preservative leading to in vitro fermentation, calibration documentation gaps, and analyst methodology are all subject to examination. Understanding how SWIFS processes evidence, what their protocols require, and where those protocols break down is specific knowledge that matters in Dallas DWI cases.
The ALR hearing (the administrative license revocation proceeding that runs parallel to the criminal case)must be requested within 15 days of notice of suspension. Missing that deadline means an automatic suspension. The ALR hearing is also a strategic opportunity: testimony taken there creates a transcript that can be used in the criminal case. DWI Penalties in Texas
First DWI (Class B Misdemeanor)
Up to 180 days in county jail, fine up to $2,000, license suspension up to one year.
Second DWI (Class A Misdemeanor)
30 days to one year in jail, fine up to $4,000, license suspension up to two years. A 30-day mandatory minimum jail sentence applies.
Third DWI (Third Degree Felony)
2 to 10 years in prison, fine up to $10,000, license suspension up to two years.
DWI with a Child Passenger (State Jail Felony)
180 days to 2 years in state jail, fine up to $10,000. A child under 15 in the vehicle at the time of the offense triggers this enhancement regardless of the driver’s BAC.
Intoxication Assault (Third Degree Felony)
2 to 10 years, fine up to $10,000.
Intoxication Manslaughter (Second Degree Felony)
2 to 20 years, fine up to $10,000. If the deceased was the parent of a minor child, the court is now required under Texas Code of Criminal Procedure Article 42.0375 (“Bentley’s Law”) to order monthly child support restitution for that child until they turn 18 or graduate high school.
