We understand the gas chromatography-flame ionization detection (GC-FID) methodology used to analyze blood samples, including sources of error such as coelution, contamination, in vitro fermentation by Candida albicans in improperly stored samples, and improper blood draw procedures. The laboratory’s analytical method, instrument calibration records, analyst qualifications, and chain of custody are examined in every blood test case.
Breath testing. We challenge breath test results based on partition ratio variability (the 2100:1 blood-to-breath ratio assumption that varies significantly between individuals and changes with body temperature). Mouth alcohol contamination from recent drinking, belching, or GERD. False positives from diabetes (acetone production), certain dietary conditions, and the specific limitations of the Intoxilyzer 9000.
Field sobriety tests. We challenge the administration, scoring, and interpretation of Standardized Field Sobriety Tests based on NHTSA protocols and the scientific literature on their reliability. Deandra Grant is a certified SFST instructor and challenges administration and scoring errors in every applicable case.
Retrograde extrapolation. When the prosecution attempts to calculate BAC at the time of driving based on a test taken later, we challenge the scientific validity of their calculation, including the assumed elimination rate and absorption phase assumptions. The science of retrograde extrapolation involves significant variability that prosecutors frequently understate.
