      Why the Science Behind Your DWI Matters

      Most DWI defense attorneys challenge procedure. The ACS-CHAL Forensic Lawyer-Scientist training held by Deandra Grant and Douglas Huff allows us to challenge the science itself:

      Blood testing.  GC-FID (gas chromatography-flame ionization detection) methodology, coelution errors, sample contamination, in vitro fermentation that can artificially elevate BAC readings in improperly stored samples, and improper blood draw procedures. The laboratory’s analytical method, instrument calibration records, analyst qualifications, and chain of custody are examined in every blood test case.

      Breath testing.  Partition ratio variability (breath testing assumes a fixed 2100:1 blood-to-breath ratio that varies significantly between individuals and is affected by body temperature). Mouth alcohol contamination from recent drinking, belching, or GERD. False positives from diabetes (acetone), certain diets, or other physiological conditions. Intoxilyzer 9000 limitations, including the machine’s proprietary source code and documented accuracy concerns.

      Field sobriety tests.  The Standardized Field Sobriety Tests (HGN, walk-and-turn, and one-leg-stand) must be administered under strict NHTSA protocols. Deviations in instruction, demonstration, or scoring affect the validity of the results. Deandra Grant is a trained SFST instructor and challenges administration and scoring errors in every applicable case.

      Retrograde extrapolation.  When the prosecution attempts to calculate a defendant’s BAC at the time of driving based on a test taken later, the retrograde extrapolation methodology (including the assumed elimination rate and the absorption phase assumptions) is challenged. The science of retrograde extrapolation involves significant variability that prosecutors frequently understate.

      The Plano Police Department operates one of the most active DWI enforcement programs in Collin County.
