Assault by Threat

Under Texas Penal Code §22.01(a)(2)–(3), a person can be charged with assault without causing any injury — either by threatening another with imminent bodily injury, or by making physical contact they know or should reasonably believe the other person will find offensive or provocative. Because there is no bodily-injury element, this is the lowest tier of assault: a Class C misdemeanor punishable by a fine of up to $500 and no jail time.

Even so, a Class C assault still creates an arrest and court record, and certain victims or circumstances can elevate the same conduct to a higher charge. We work to keep it off your record through dismissal, deferred dispositions, and other resolutions.
