Why the Science Behind Your DWI Matters
Most DWI defense attorneys challenge DWI cases by arguing that the officer didn’t follow proper procedures, i.e the traffic stop was illegal, the field sobriety tests were administered incorrectly, or the breath test machine wasn’t calibrated. These are valid challenges, and we raise them when they apply.
But our forensic training allows us to go deeper. We challenge the science itself:
- Blood testing: We understand the gas chromatography with flame ionization detection (GC-FID) methodology used to analyze blood samples, including sources of error such as coelution, contamination, in vitro fermentation by Candida albicans, and improper blood draw procedures
- Breath testing: We challenge breath test results based on partition ratio variability, mouth alcohol contamination, medical conditions like GERD and diabetes that produce false positives, and the specific limitations of the Intoxilyzer 9000
- Field sobriety tests: We challenge the administration, scoring, and interpretation of Standardized Field Sobriety Tests based on the NHTSA protocols and the scientific literature on their reliability

First Offense (Class B Misdemeanor)

- Driver’s license suspension of 90 days to 1 year

First Offense with BAC 0.15+ (Class A Misdemeanor)
- Up to 1 year in county jail
- Fine of up to $4,000
- Mandatory ignition interlock device
- Permanent conviction — no deferred adjudication available
Second Offense (Class A Misdemeanor)
- 30 days to 1 year in county jail
- Fine of up to $4,000
- Driver’s license suspension of 180 days to 2 years
- Mandatory ignition interlock device
Third Offense (Third-Degree Felony)
- 2 to 10 years in the Texas Department of Criminal Justice
- Fine of up to $10,000

The 15-Day ALR Deadline
