Can You Get Off the Sex Offender Registry in Texas?

Who Is Eligible for Early Termination

Under Texas Code of Criminal Procedure Article 62.404, a person subject to sex offender registration may petition the court for an order exempting the person from registration if they meet certain criteria. However, the statute creates important limitations:

Eligible

  • Persons with a single reportable conviction that is not a sexually violent offense
  • Persons who have completed their sentence (including any term of community supervision)
  • Persons who have complied with all registration requirements
  • Persons who can demonstrate that they are not a current or future threat to public safety

Not Eligible

  • Persons convicted of a sexually violent offense (as defined by Article 62.001(6))
  • Persons subject to lifetime registration for offenses involving victims under 17
  • Persons with more than one reportable conviction
  • Persons determined to be sexually violent predators

The practical effect is that early termination is available primarily for adults convicted of sexual assault involving an adult complainant, certain indecency offenses, and other non-aggravated reportable offenses.

The Process

A petition for early termination of registration is filed in the trial court that sentenced the person for the reportable conviction. The process involves:

  • Filing the petition. The petition must demonstrate that the registrant meets the statutory eligibility criteria and is not a current or future threat to public safety.
  • State’s response. The State has the opportunity to oppose the petition. Prosecutors often oppose early termination, requiring the petitioner to present persuasive evidence.
  • The court conducts a hearing at which both sides present evidence. The registrant bears the burden of proof.
  • Court’s evaluation. The court considers the nature of the offense, the registrant’s criminal history, treatment and rehabilitation efforts, risk assessment results, community ties, employment history, and any other relevant factors.
  • Expert evaluation. The court may require or consider a sex offender risk assessment conducted by a licensed professional. A favorable assessment can be a powerful factor in the court’s decision.
