Inconsistent Officer Statements in DWI Cases

Sometimes the question comes up about how inconsistent statements between police officers can affect a DWI case, and sometimes it can be a real factor.

You might have one officer asking another, “Did you see anything? Because I didn’t see anything.”

Then the other officer says, “Oh yes, I saw X, Y, and Z.”

That kind of inconsistency can be a strong starting point for cross-examination at trial, showing the officers were not in agreement about whether intoxication was actually present.
